John Armor.   John Armor, who practiced 33 years in the US Supreme Court and is Counsel to the American Civil Rights Union (ACRU), made the following statement:  “The Fairness Doctrine was based on the ‘fact’ that broadcast bandwidth is ‘scarce,’ whereas, anyone can start a newspaper.  That ‘fact’ was narrowly true when the Red Lion case was decided in 1969.  Since then, hundreds of newspapers have folded, while cable and satellite have brought hundreds of broadcast channels to most Americans.  In short, if this Doctrine has another test against the First Amendment in the Supreme Court, it should lose and probably will.
